MDL-3094 GLP-1 GI litigation: ~3,600 cases consolidated in EDPA before Judge Marston

Judge Karen S. Marston (EDPA) oversees the federal GLP-1 gastrointestinal-injury MDL. As of mid-2026, bellwether trial dates are not yet publicly scheduled; a Science Day was set for June 2, 2026. NAION (vision-loss) claims are consolidated separately as MDL-3163.

Judge Karen S. Marston (US District Court, Eastern District of Pennsylvania) presides over MDL No. 3094, the consolidated federal litigation alleging gastrointestinal injuries (gastroparesis and related conditions) from GLP-1 receptor agonists. As of mid-2026, bellwether trial dates had not been publicly scheduled; sources indicate bellwether trials are expected no earlier than mid-to-late 2026, and a Science Day was set for June 2, 2026.

Bellwether selection has focused on plaintiffs with documented gastric-emptying scintigraphy + wireless motility studies. The court has separated NAION (vision-loss) cases into MDL-3163, where consolidation is ongoing.

Editorial context: we maintain the /legal/glp1-lawsuit-tracker page with current case counts + evidence requirements. Per JPML statistics (mid-2026), roughly 3,600 cases are pending in MDL-3094 and ~86 in MDL-3163; counts change as new filings transfer in. We do not refer to law firms; this page exists to surface neutral information.

For patients currently on a GLP-1 with severe GI symptoms: stop the next dose, contact your prescriber, and read our /safety/gastroparesis page for the practical workup. ASA 2023 guidance on anesthesia aspiration applies if any procedures are scheduled.
