MDL-3094 gastroparesis litigation: first bellwether trials scheduled for Q4 2026

Judge Marston (EDPA) sets the first three bellwether trials in MDL-3094 for October-December 2026. Case count crosses 3,200 plaintiffs. Anesthesia-aspiration claims consolidated separately.

Judge Karen S. Marston (US District Court, Eastern District of Pennsylvania) set the schedule for the first three bellwether trials in MDL-3094 (GLP-1 gastroparesis/ileus) on May 18, 2026. Trials are scheduled for October 6, November 3, and December 1, 2026.

Bellwether selection focused on plaintiffs with documented gastric-emptying scintigraphy + wireless motility studies. The court has separated NAION cases into MDL-3163, where consolidation is ongoing.

Editorial context: we maintain the /legal/glp1-lawsuit-tracker page with current case counts + evidence requirements. The 3,127-case count from our last update is now ~3,210 as new filings continue. We do not refer to law firms; this page exists to surface neutral information.

For patients currently on a GLP-1 with severe GI symptoms: stop the next dose, contact your prescriber, and read our /safety/gastroparesis page for the practical workup. ASA 2023 guidance on anesthesia aspiration applies if any procedures are scheduled.
